Heard Mr. Sh. Athoi Singh, learned counsel appearing for the petitioner in WP(C) No. 194 of 2022, Mr. S. Samarjeet, learned counsel appearing for the petitioner in WP(C) No. 733 of 2022. Heard also Mr. Shyam Sharma, learned G.A. appearing for the respondents.

Since the facts and issues raised in the present 3 (three) writ petitions are identical, the same are being disposed of by this common order.

The present 3 (three) writ petitions have been filed with a prayer for directing the Deputy Commissioner, Kakching to issue status certificates to the individual applicants belonging to different Sageis as mentioned hereunder:

(1) 19 (nineteen) identified Sageis in respect of Waikhong Village, viz, (i) Sapam, (ii) Abujam, (iii) Sanasam, (iv) Khuraijam, (v) Elangbam, (vi) Thoudam, (vii) Keisam, (viii) Laishram, (ix) Khumanthem, (x) Oinam, (xi) Kshetrimayum, (xii) Huidrom, (xiii) Chirom, (xiv) Moirangthem, (xv) Soibam, (xvi) Hidam, (xvii) Angom, (xviii) Hijam & (xix) Thounaojam;

(2) 11 (eleven) identified Sageis in respect of Sugnu Village, viz, (i) Khaidem, (ii) Yumlembam, (iii) Nongmaithem, (iv) Moirangthem, (v) Angom, (vi) Ningthoujam, (vii) Hijam, (viii) Thokchom, (ix) Aheibam, (x) Abujam & (xi) Sarangthem; and

(3) 8 (eight) identified Sageis in respect of Wangoo Village, viz, (i) Amom, (ii) Loitongbam, (iii) Sanasam, (iv) Khangembam, (v) Sagolsem, (vi) Yumnam, (vii) Moirangthem & (viii) Laishram.

It has been submitted by the learned counsel appearing for both the parties that similar issue with regard to granting scheduled caste certificate to the applicants belonging to the aforesaid Sageis residing in Waikhong Village, Sugnu Village and Wangoo Village had already been decided by this Court in its judgment and order dated 09.11.2021 passed in WP(C) No. 86 of 2021 and that the issue raised in the present 3 (three) writ petitions are squarely covered by the said judgment and order dated 09.11.2021. The learned counsel appearing for the petitioners submitted that the present writ petitions can be disposed of in terms of the said judgment and order.

Mr. Shyam Sharma, learned G.A. appearing for the respondents, submitted that in the counter affidavit filed by respondent No. 2 in WP(C) No. 194 of 2022, it has been admitted by the authorities that the Deputy Commissioner, Kakching is the competent authority to consider and identify the eligible candidates and to issue scheduled caste certificate. The learned counsel also fairly submitted that the issue raised in the present writ petitions is squarely covered by the aforesaid judgment and order dated 09.11.2021 passed by this Court in WP(C) No. 86 of 2021 and the present writ petitions can be disposed of in terms of the said judgment and order.

In view of the submissions of the learned counsel appearing for the parties and on perusal of the record of the present cases, this Court is of the view that the present writ petitions can be disposed of by granting similar relief as has been granted by this Court in its judgment and order dated 09.11.2021 passed in WP(C) No. 86 of 2021.

Accordingly, the present writ petitions are disposed of by directing the Deputy Commissioner, Kakching to consider the claim of the present petitioners strictly in terms of the judgment and order dated 09.11.2021 passed by this Court in WP(C) No. 86 of 2021 and to issue necessary certificates. It is also directed that the whole process should be completed within a period of 4 (four) months from the date of receipt of a copy of this order

With the aforesaid directions, the present 3 (three) writ petitions are disposed of.
