This petition has been filed seeking to direct the respondents to dispose the petitioner's application No.2026/0178/30/000006 dated 09.01.2026 to

fix the four boundaries and to lay the boundary stones in Town Survey No.J-13/122, Nagercoil South Village, Block -13 of Nagercoil Municipal Corporation Ward No.44, Agasteeswaram Taluk, Kanniyakumari District.

The learned counsel for the petitioner submitted that the petitioner purchased the property through a sale deed dated 20.01.2005. Therefore, the petitioner seeks to have the property surveyed and demarcated, and to install boundary stones on all four sides.

The learned Additional Government Pleader appearing for the respondents submitted that a survey had already been conducted as early as 2025. He further submitted that the petitioner had not provided the boundary stones, and therefore, the same could not be installed. He also stated that the petitioner filed another application and paid the requisite fee on 09.01.2026.

Considering the facts and circumstances of the case, this Court directs the third respondent to conduct a survey, demarcate the boundaries, and install boundary stones after issuing notice to the petitioner as well as any rival claimants. The petitioner shall provide the boundary stones at his own cost. If required, the jurisdictional police shall extend protection to facilitate the survey and demarcation of the property. The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures:

a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

¶33

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.

The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.

5 . With the above directions, this Writ Petition is disposed of. No costs.
