This Writ Petition has been filed seeking the issuance of a Writ

of Mandamus directing the respondents to remove the high-tension electric

¶27

pole erected in the petitioner's patta land comprised in Survey Nos.351/5 and 351/7, situated at South Thathamangalam Village, Mannachanallur Taluk,

Tiruchirappalli District, in the light of the order passed by this Court in W.P.No.31346 of 2024, dated 21.10.2024, within such time as may be fixed by this Court.

2. By consent of the learned counsel appearing on either side, this Writ Petition is taken up for final disposal at the stage of admission itself.

3. Since no adverse order is proposed to be passed against the

fifth respondent in this Writ Petition, notice to the fifth respondent is dispensed with.

4. The learned counsel appearing for the petitioner submitted that, despite the order passed by this Court in W.P.No.31346 of 2024, dated 21.10.2024, the respondents have not taken any effective steps to remove the

high-tension electric pole erected in the petitioner's patta land. It is further submitted that the petitioner has submitted a representation dated 04.03.2026

requesting the respondents to implement the said order. However, no orders have been passed on the said representation till date. Hence, the petitioner has approached this Court by filing the present Writ Petition.

The learned counsel for the petitioner further submitted that the petitioner would be satisfied if this Court issues a direction to the competent authority to consider the petitioner's representation dated 04.03.2026 and pass appropriate orders thereon within a time frame to be fixed by this Court.

Considering the facts and circumstances of the case, and without expressing any opinion on the merits of the petitioner's claim, this Writ Petition is disposed of with a direction to the competent authority to consider the petitioner's representation dated 04.03.2026, after affording an adequate opportunity of hearing to the petitioner, the fifth respondent, and all other necessary and interested parties, if any, and thereafter pass appropriate orders on merits and in accordance with law.
