O R D E R

This Writ Petition has been filed for a direction, directing the respondents 1 and 2 to defreeze the petitioners’ savings and salary accounts and restore the operations thereof.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioners are claiming to be employees of 3 rd respondent herein and they have received salary from the 3 rd respondent. Now, on the complaint lodged by the 4 th respondent, the 2 nd respondent has instructed the petitioners’ respective bankers to freeze their accounts.

4.The learned counsel appearing for the petitioners submits that they have nothing to do with the 4 th respondent since they are employees of the 3 rd respondent. Whatever work they done, they have received their salary. They have nothing to do in the crime committed by the 3 rd respondent herein. He further submits that the respondents did not even follow the procedure as

contemplated under BNSS and without complying the provision under Section 106(3) of BNSS.

5. The learned counsel appearing for the respondents 4 and 5, on instructions, submits that the petitioners herein are fake employees of the 3rd respondent. He further submits that the 4 th respondent engaged the 3 rd respondent for doing certain work over which the 3 rd respondent claiming salary in the name of fake persons, without doing any work. Due to which, the 4 th respondent had deposited Rs.43,51,259/-. Therefore, on the complaint lodged by the 4 th respondent, the Inspector of Police, Cyber Crime Wing, Coimbatore City, registered FIR in Crime No.22 of 2026 for the offences punishable under Section 66-D of the Information Technology Act, 2000.

6. In pursuant to the registration of FIR and on the request made by the Investigation Agency, the respective bankers have frozen the petitioners’ accounts. Now, the investigation is pending in Crime No.22 of 2026 on the file of the Inspector of Police, Cyber Crime Wing, Coimbatore City. That apart, they also duly complied with the provisions under Section 106(3) of BNSS.

7. In view of the above, while pending investigation, the request

made by the petitioners seeking defreeze of their respective accounts cannot be considered and the writ petition is devoid of merits and the same is liable to be dismissed.

8. Accordingly, the Writ Petition (Criminal) is dismissed. No costs.
