Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent Board to consider our representation dated 11.8.2011, 27.2.2012, 14.4.2012, refix our pay as directed by this Honourable Court dated 23.10.2007 in W.P. No.10120 of 2002 read with the proceedings of the respondent dated 31.12.2008, 9.4.2010, 22.7.2010 and pay the difference of pay and the difference in pension for the services petitioners rendered in CCP and the respondent Board together with interest at the rate of 18% per annum within four weeks.

ORDER

When the Writ Petition is taken up for hearing, the learned Senior

Counsel appearing for the respondent submitted that the respondent-Board has paid the difference in pay/pension to all the petitioners herein except the 5^th petitioner herein.

The learned Senior Counsel further submitted that, insofar as the

5^th petitioner is concerned, the respondent-Board is willing to pay the difference

¶41

of pay/pension. However, since the 5^th petitioner had deceased, the legal heirs of the deceased 5^th petitioner are required to approach the concerned authority to claim the said amount along with the legal heir certificate and other relevant documents, upon which the respondent would disburse the said amount.

The learned Senior Counsel also submitted that if the legal heirs of

the 5^th petitioner approach the respondent authority, they shall pay the difference of pay/pension in accordance with law.

In response, the learned counsel for the petitioners requested this

Court to record the aforesaid submissions made by the learned Senior Counsel for the respondent with regard to the respondent’s willingness to pay the difference of pay and difference in pension to the legal heirs of the deceased 5^th petitioner.

Accordingly, the submission made by the learned Senior Counsel

on behalf of the respondent is taken on record.

Further, taking note of the fact that the respondent has already paid the difference of pay and difference in pension to all the petitioners except the 5^th petitioner and having expressed its willingness to pay the difference of pay/pension to the legal heirs of the deceased 5^th petitioner upon submission of the necessary documents, this Court is of the view that nothing further survives for further consideration in this Writ Petition.
