This Writ Petition has been filed for the following relief:

“To issue a writ of mandamus for forbearing the respondents from auctioning the property of the petitioner situated at Flat bearing No.H situated on the second floor of the premises of an apartment having a super built up area of 1084 square feet, together with 541 square feet of undivided share, right, title and interest over the land measuring 4876 square feet, situated at Plot No. 1866, 26^th Street, Thiruvallluvar Kudiyiruppu, Anna Nagar West, Chennai 600040 till the disposal of the appeal pending on the file of the 1^st respondent in appeal petition Govt. Letter No. 3124949/G/2022-15 and the Proclamation of sale dated 18.12.2025 issued by the XXVI Assistant City Civil Court at Chennai in ARC No.527 of 2024 in E.P.No. 1363 of 2020.”

The learned counsel for the petitioner, on instructions, would

submit that the petitioner is ready to deposit a sum of Rs.18,00,000/-

W.P.No.74 of 2026 (Rupees eighteen lakhs only) to the credit of E.P.No.1363 of 2020 in A.R.C.No.526 of 2014 on the file of the XXVI Assistant Judge, City

Civil Court, Chennai within a period of three weeks from today.

In view of the above submission made by the learned counsel for the petitioner, the writ petition is disposed of with a direction to the petitioner to deposit a sum of Rs.18,00,000/- (Rupees eighteen lakhs only) to the credit of E.P.No.1363 of 2020 in A.R.C.No.526 of 2014 on the file of the XXVI Assistant Judge, City Civil Court, Chennai within a period of three weeks from today and on such deposit, the auction with reference to the petitioner’s property shall remain stayed. Till such time, steps shall not be taken to auction the property of the petitioner alone. It is needless to state that if the amount is not deposited within the stipulated time, it is open to the respondents to proceed against the petitioner’s property in accordance with law. No costs. Consequently, connected miscellaneous petitions are closed.
