PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, directing respondents 1 to 4 to remove the wrongly entered name Devesahayam from the Column of father’s name in the birth Certificate of petitioner’s son, Master Asher Xander Devesahayam, bearing Registration No.B-2021:33-16512-000013 dated 05.05.2021 and consequently, direct fourth respondent to issue a corrected birth certificate leaving father’s name column blank and petitioner’s name has been shown as Mother/single Parent of Master Asher Xander Devesahayam, in view of petitioner’s representations dated 16.06.2026 and 17.06.2026, within a time frame to be fixed by this Court.

The present writ petition has been filed for a direction to respondents 1 to 4 to remove the name of Devesahayam from column of father’s name in birth Certificate of petitioner’s son, Master Asher Xander Devesahayam, bearing Registration No.B-2021:33-16512-000013 dated 05.05.2021 and consequently direct fourth respondent to issue a corrected birth certificate leaving father’s name column blank and petitioner’s name as Mother/single parent of Master

Asher Xander Devesahayam, in view of petitioner’s representations dated 16.06.2026 and 17.06.2026, within a time frame to be fixed by this Court.

Learned Counsel for first respondent would submit that fourth respondent would have to correct the birth certificate and report it to first respondent.

Learned State Counsel for respondents 2 to 4 would submit that fourth respondent would correct birth certificate of petitioner’s son by considering petitioner’s representations dated 16.06.2026 and 17.06.2026, keeping in view the procedure laid down in Section 15 of the Registration of Births and Deaths Act, 1969 read with Rule 11 of Tamil Nadu Registration of Births and Deaths Rules, 2000, after issuing notice to petitioner, fifth respondent and any other interested party and report it to first respondent, agreed to by learned counsel for petitioner.

4. In view thereof, this Court is inclined to dispose of writ petition with following directions:

i) Fourth respondent shall consider petitioner’s representation dated 16.06.2026 and 17.06.2026 on its own merits and pass apporpriate orders, keeping in view the procedure laid down in Section 15 of the Registration of Births and Deaths Act, 1969 read with Rule 11 of Tamil Nadu Registration of

Births and Deaths Rules, 2000, after issuing notice and affording reasonable opportunity of hearing to petitioner, fifth respondent and any other interested persons. Fourth respondent shall report the same to first respondent;

ii) Petitioner shall appear before fourth respondent on 14.07.2026 at 11:00

ii i) It is open to petitioner to place reliance on any orders of this Court and if any such orders are placed, the same shall be considered while passing orders;

v) The entire exercise shall be completed within a period of two (2) weeks from the date of uploading of web copy without waiting for the receipt of certified copy ;

vi) It is made clear that this Court has not expressed any views with regard to the merits of the case.

5. Accordingly, writ petition stands disposed of. There will be no order as to costs.
