Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Mandamus, to direct the 3rd Respondent to issue an amended Noted For Record Letter with respect to the petitioner’s 24 MW Solar Plant bearing SPG No.059514600251 for modification of its group captive consumers, as per the petitioner’s application dated 02.06.2026 and consequently, direct the 5th respondent to execute the fresh Energy wheeling Agreement in the SPG No. 059514600251.

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, to direct 3rd Respondent to issue an amended Noted For Record Letter in respect of petitioner’s 24 MW Solar Plant bearing SPG No.059514600251 for modification of its group captive consumers, pursuant to petitioner’s application dated 02.06.2026, and consequently direct the 5th respondent to execute a fresh Energy wheeling Agreement in respect of SPG No. 059514600251.

Learned counsel for petitioner pointed out that in terms of Regulation

16 of the Tamil Nadu Electricity Regulatory Commission Grid Connectivity and Intra-State Open Access Regulations, 2014, an application seeking open access

is required to be considered within three days from the date of its receipt. Though petitioner had taken out an application as early as on 02.06.2026, no

orders have been passed by the fourth respondent either granting or refusing consent.

Pursuant to the earlier direction of this Court, the concerned officer was present before this Court to explain as to why the timeline stipulated under the said Regulations had not been complied with. It was submitted that more than Rs.17 crores is due from petitioner and No Objection Certificate has not been submitted from Distribution Licensee.

In response, learned counsel for petitioner, on instructions, submitted the following:

(a) Allegation of Dues of about Rs.17 crores by petitioner is baseless;

(b) Requirement of a No Objection Certificate from the Distribution

¶35

Licensee under Regulation 16 is concerned, such certificate had already been obtained and furnished to the fourth respondent.

This Court is not inclined to go into the question as to whether the above statement relating to the alleged dues is right or otherwise. However, this Court finds that irrespective of the reason assigned, there is a duty cast on the

authority under Regulation 16 to process the application and pass orders within a period of three days, that has not been complied with.

Learned Standing Counsel appearing for respondents, on instructions, would submit that appropriate orders would be passed within 48 hours. It is further submitted that before passing such orders, petitioner would be afforded an opportunity of personal hearing to enable him to respond in respect of the two aspects, namely, (i) the alleged dues of Rs.17 crores, and (ii) the alleged non furnishing of the No Objection Certificate by the Distribution Licensee.

Recording the above submission, petitioner is directed appear before the fourth respondent on 08.07.2026 at 11.00 a.m, along with the relevant material in respect of the above two aspects. The fourth respondent while considering petitioner’s application dated 02.06.2026, afford an opportunity of hearing to petitioner, and pass appropriate orders, on merits and in accordance with law, on or before 10.07.2026.

Learned counsel for petitioner further submitted that petitioner is entitled to the benefit / credit in respect of the electricity generated during the month of May 2026.

It is open to petitioner to submit a separate representation before the appropriate respondent on the above aspect as well. If any such representation is made, the fourth respondent, while considering the above aspect shall also pass appropriate orders on this request of petitioner as well, in accordance with law. It is made clear that this Court has not expressed any views on the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.

10. Accordingly, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
