This Writ Petition has been filed for the following reliefs:-

“ for a direction to the respondents no.2 to 4 to consider and post the

petitioner on diversion or on transfer as staff nurse in the government hospital, Tenkasi or in ESI Dispensary, Tenkasi by considering her family circumstances as mentioned in the representation dated 18.03.2026 within a time frame fixed by this Hon'ble Court and for such other order or directions deem fit and proper in the circumstances of the case.”

Brief Facts:-

The petitioner would submit that she was appointed as a Staff Nurse on a consolidated pay basis on 30.10.2015 and was initially posted to the Government Primary Health Centre, Kothankudi, Thanjavur District. Subsequently, by proceedings dated 23.02.2016, she was transferred to the Government Primary Health Centre, Elathur, Sankarankoil HUD, Tirunelveli

District, where she continued to serve. Her services were regularised by the second respondent by proceedings dated 14.03.2024, granting her regular time scale of pay. Consequent to such regularisation, she was transferred and posted to the Rajiv Gandhi Government Hospital, Chennai.

The petitioner would submit that she got married in the year 2018 and has a minor son, aged about seven years, who is studying in the second standard at Tenkasi. Her husband is employed as an MMU Driver in the Department of Public Health and Preventive Medicine at Sankarankoil. Both her father and father-in-law have passed away, while her aged mother and mother-in-law are suffering from age-related ailments and require continuous care and medical attention.

The petitioner would further submit that owing to her posting at Chennai, the petitioner has been compelled to live away from her family at Tenkasi, causing considerable hardship in taking care of her minor son and her aged mother and mother-in-law. The frequent travel between Chennai and Tenkasi, coupled with prolonged separation from her family, adversely affected her physical and mental health. During this period, she had suffered a miscarriage on 03.12.2025 and underwent medical treatment, availing medical leave from 03.12.2025 to 26.12.2025.

Considering her family circumstances, medical condition and the

welfare of her minor child, the petitioner had submitted a representation dated 18.03.2026 requesting the respondents to post her on diversion or by transfer as a Staff Nurse in the Government Hospital, Tenkasi, or the ESI Dispensary, Tenkasi. However, to date, no orders have been passed on the said representation. Hence, this Writ Petition.

Heard the learned counsel on either side and perused the records.

Considering the relief sought for by the petitioner and in the absence

of any serious objection from the learned counsel appearing for the respondents, this Court, without going into the merits of the case, directs the respondents 2 to 4 to consider the petitioner's representation dated 18.08.2026 sympathetically, taking into account her family circumstances, and pass appropriate orders for posting/transferring her to a station nearer to her hometown, within a period of three weeks from the date of receipt of a copy of this order.
