3.It is the further case of the petitioner that since Record Clerks were continuing their service without any promotion, the Government issued orders and upgraded their post from the cadre of Record Clerk to Record Assistant. On completion of ten years in the post of Record Clerk or as per his seniority, the petitioner is entitled for upgradation as Record Assistant from 02.03.2009 onwards. But the Respondents denied the petitioner’s claim and granted upgradation after a lapse of six years ie.., on 26.05.2015. It is also the case of the petitioner that as per the order of this Court made in W.A.No.192/2020, made in favour of the petitioner’s colleagues, the petitioner is also entitled for upgradation from the post of Record Clerk to Record Assistant from 02.03.2009 onwards. Therefore, the petitioner made a representation to the respondents on 30.12.2021 with a request to revise his promotion order and thereby promote him on par with his juniors notionally and to revise his pay. However, the representation of the petitioner is yet to be considered by the respondents. Hence, the petitioner has filed the present Writ Petition with the above said prayer.
