ORDER

The Writ Petition is filed seeking for the following prayer;

“directing the 2^nd Respondent to consider the petitioner’s appeal dated 15.09.2025 for reimbursement of medical expenses incurred by him for his treatment/illness a sum of Rs.97,269/along with interest in terms of the order of this Court dated 28.05.2019 made in W.P. (MD) No.13429 of 2013 and Etc., Batch of cases within time stipulated to be fixed by this Court.”

2.The case of the petitioner is that the petitioner is a pensioner and had retired as Forest Range Officer and is now drawing pension as per the Tamil Nadu Pension Rules and this is his only source of livelihood. It is his further case that he suffered from Retinal Detachment and Cellulities, a bacterial skin infection and had undergone eye surgery and further had undergone treatments for recovery from skin disease in private hospitals for the respective treatments in the year 2024 i.e., from 10.02.2024 to 14.02.2024. It is further averred that he is a member of New Health Insurance Scheme 2018 for Pensioners including spouse and family members of Pensioners and that subscription from his

pension was deducted as per the said scheme. The said scheme would provide for financial assistance up to Rs.4 lakhs with a provision to pay up to Rs.7.5. lakhs for approved treatment taken and surgeries undergone.

3.Since the petitioner incurred an amount of Rs.97,269/- towards medical expenses for treatment undergone from 10.02.2024 to 14.02.2024 for Cellulities treatment, he made an application to the third respondent/the Pension Pay Officer on 21.11.2024, for the reimbursement towards the medical expenses incurred by him along with medical bills and other documents, but the same was returned by the third respondent vide proceedings dated 25.11.2024, for the need of several other documents and requesting him to approach the second respondent. However, his claim came to be rejected by the fourth respondent on the ground that his illness was not covered under the scheme and also directed him to approach the second respondent vide letter dated 12.02.2025. Therefore, the petitioner made an appeal to the second respondent on 15.09.2025 and the same is pending without any progress till date. Hence, the present Writ Petition has been filed with the above said prayer.

4.Heard the learned counsel on either side and perused the materials available on record.

Considering the relief now sought for by the petitioner, this Court,

without going into the merits of the case, directs the second respondent to consider the petitioner's appeal dated 15.09.2025 and to pass orders, on merits

and in accordance with law, within a period of one (1) month from the date of receipt of a copy of this order.

6.The Writ Petition is disposed of accordingly. No costs.
