The present Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the 1^st respondent to forthwith consider and pass orders on the statutory appeal of the petitioner dated 14.02.2026 after affording a reasonable opportunity of personal hearing to the petitioner.

The case of the petitioner is that the petitioner joined basic recruit training at the Police Training School, Idayapatti, Madurai, on 06.06.2023 and due to the illness, availed medical leave from 01.07.2023 to 08.07.2023, rejoining on 09.07.2023. Owing to severe mental stress arising from a grave family financial crisis and heavy debts, the petitioner left the training centre on 12.07.2023, resulting in unauthorized absence. A charge memo dated 30.10.2023 under Rule 3(b) of the TNPSS (D&A) Rules was issues, and an oral enquiry was conducted on 21.12.2023, wherein the petitioner admitted the lapse and explained the compelling circumstances. 26.02.2024, the 2^nd respondent imposed the punishment of removal from service. Aggrieved thereby, the petitioner filed a statutory appeal on 14.02.2026 before the 1^st respondent seeking to set aside the removal order and for reinstatement in service and till date, the same has not been disposed of. Hence, the present Writ Petition is filed.

Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for respondent Nos.1 and 2.

Considering the facts and circumstances of the case and the submission made by the learned counsel for both parties, this Court directs the first respondent to consider the statutory appeal filed by the petitioner and pass appropriate orders, on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order, after affording one opportunity of personal hearing to the petitioner. In the event the petitioner fails to appear on the date fixed for personal hearing, no further opportunity for a personal hearing should be granted to the petitioner.
