PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents to issue permanent patta to the petitioner against the land situated in S.No. 42/2A at Tallakulam Village, Madurai based on the assignment proceedings no. R.Dis. 19729.G.49-A10 dated 25.12.1950 by considering the petitioner's representation dated 23.08.2025 within stipulated period as fixed by this Court.

By relying on assignment of punja land in survey No.42/2A in favour of the petitioner's grandfather A.S.Arunachalam Nadar, the petitioner had applied for a permanent patta. The present Writ Petition relates thereto.

Learned counsel for the petitioner relied on the legal heirship certificate of Arunachala Nadar and pointed out that one Thirupathi, who is shown as one of the legal heirs, passed away and is survived by one Vanaja. As regards Alagarsamy, he submits that the said Alagarsamy passed away on 28.10.2024 and is survived by four legal heirs, including

the petitioner. The third legal heir of Arunachalam Nadar, Mrs.Rameshwari, is said to be alive.

Learned Government Advocate accepts notice on behalf of all the respondents. He submits that the fourth respondent would consider the petitioner's request for patta after issuing notice to all the surviving legal heirs of Arunachalam Nadar.

Accordingly, without making any observations on the merits, this Writ Petition is disposed of by directing the fourth respondent to consider and dispose of the petitioner's representation dated 23.08.2025 after providing a reasonable opportunity to the petitioner and all other legal heirs of the late Arunachalam Nadar. A speaking order shall be issued within four (4) months from the date of receipt of a copy of this order. No costs.
