Prayer : Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order in Na.Ka.NO.4748/A2/2019 dated 15.10.2019 on the file of the respondent No.2 and quash the same as illegal and consequently for a direction, directing the respondent No.2 to appoint the petitioner in the post of Grade III Librarian by way of recruitment by

transfer from the post of Village Librarian with effect from 06.10.2013 along with all monetary benefits and arrears of pay by extending the benefit of Government Orders in G.O.Ms.No.64 School Education Department, dated 12.05.2006, G.O.Ms.No.243 School Education Department, dated 27.11.2006, G.O.Ms.No.60 School Education Department, dated 18.02.2009, G.O.Ms.No.164 School Education Department, dated 28.10.2011, G.O.Ms.No.101 School Education Department, dated 12.05.2015 within the time period stipulated by this Court.

ORDER

When the matter came up for hearing today, the learned Additional Government Pleader would submit that the proceedings in Na.Ka.No. 4454/A/2023 dated 28.02.2024, in and by which, the petitioner was considered for promotion and appointed as the Librarian Grade-III.

2.At this juncture, the learned counsel for the petitioner would submit that nothing survives for adjudication in the present writ petition. Hence, he prays to dismiss the same seeking leave to challenge the proceedings dated 28.02.2024 in respect of the date of commencement of regularisation.

3.In view of the aforesaid submission, the writ petition is dismissed as

infructuous. However, liberty is given to the petitioner to challenge the proceedings dated 28.02.2024 so far as to the extend of the date of commencement of regularization, in accordance with law and on its own merits. No costs. Consequently, connected miscellaneous petition is closed.
