ORDER

The petitioner herein seeks a direction to the first respondent to issue a patta to their land comprised S.No.682/19, situated at Kayalpattinam, Tiruchendur Taluk, Thoothukudi District, by considering his representation dated 15.11.2022.

Heard the arguments of Mr.M.Seeni Sulthan, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader, who took notice for the respondents. By consent of both sides, this writ petition is taken up for final disposal at the admission stage itself.

It is the case of the petitioner that the above mentioned property was purchased by his father A.K.Sahul Hameed under various sale deeds along with a larger extent of property. A portion of the property to an extent of 0.10.0 Hectare, was given to the Government Girls High School, Kayalpattinam. The remaining extent of 29.10 cents are under the control of the petitioner's family.

During UDR survey, the above mentioned property, which is under the enjoyment and possession of the petitioner's family, has been wrongly classified as the property belongs to the Government Girls High School, Kayalpattinam. Therefore, the petitioner submitted a representation before the first respondent on 15.11.2022 seeking correction of the erroneous entry in UDR records and inclusion of the petitioner's name. As the said representation has not been considered till date, the petitioner has come forward before this Court.

Mr.A.Baskaran, learned Additional Government Pleader, who took notice for the respondents, would submit that already the first respondent, by his proceedings in X.K.(b6)/385282/2022 dated 29.11.2022, directed the second respondent to send a report with regard to the representation made by the petitioner. He would further submit that as soon as the first respondent receives the report from the second respondent, the representation of the petitioner will be considered on merits.

In view of the said submission made by the learned Additional Government Pleader appearing for the respondents, the second respondent is directed to send a report to the first respondent within a period of four weeks from the date of receipt of a copy of this order. On receipt of such report, the

first respondent shall consider the representation of the petitioner dated 15.11.2022 and pass final orders on its own merits within a period of eight weeks thereafter, after issuing notice to the Government Girls High School, Kayalpattinam.
