Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of the second respondent's impugned demand notice bearing Lr.No..No: SE/ VREDC/VDR/DFC/AO(Rev)/AAO/HT/F.Doc/D.No: /23 dated 02.08.2023 in so far as levy of alleged parallel operation charges on the petitioner's 4.95MW Biomass Power Plant and quash the same as arbitrary, illegal and contrary to Regulation 26 of the TNERC's (Grid Connectivity and Intra State Open Access) Regulations, 2014 and the order passed by Hon'ble The Appellate Tribunal For Electricity in I.A. No.738 of 2019 in Appeal No.214 of 2019 dated 18.07.2019 and consequently direct the fourth respondent to rework the impugned CC bills from the month of October/2022 onwards and refund the parallel operation charges illegally collected from the petitioner to till date.

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records of the second respondent's demand notice bearing Lr.No..No: SE/ VREDC/VDR/DFC/ AO(Rev)/AAO/HT/F.Doc/D.No: /23 dated 02.08.2023 in so far as levy of alleged parallel operation charges on the petitioner's 4.95MW

Biomass Power Plant and quash the same as arbitrary, illegal and contrary to Regulation 26 of the TNERC's (Grid Connectivity and Intra State Open Access) Regulations, 2014 and the order passed by The Appellate Tribunal For Electricity in I.A. No.738 of 2019 in Appeal No.214 of 2019 dated 18.07.2019 and consequently direct the fourth respondent to rework the impugned CC bills from the month of October, 2022 onwards and refund the parallel operation charges illegally collected from the petitioner to till date.

2.The learned counsel appearing for the petitioner submitted that during the pendancy of this writ petition, the issue involved in the writ petition was settled before the Appellate Tribunal For Electricity in Appeal No.214 of 2019 and hence nothing survives for adjudication in this writ petition.

3.Recording the submission made by the learned counsel appearing for the petitioner, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
