3.It is submitted by the learned counsel for petitioner that petitioner had acquired a portion of property from her father bearing Plot Nos.10, 21 and 22 comprised in S.Nos.110 and 111/2, measuring an extent of 3500 sq.ft. out of larger extent of 1 acre 47 cents and forming part of Old patta No.51, New Patta No.11496, situated at Thiruverkadu Village, Poonamallee Taluk, Chennai District. Later, petitioner purchased a vacant land bearing Plot Nos.11 and 12 from her brother. It is submitted that ever since such acquisition and purchase, petitioner has been in continous possession and enjoyment of the abovementioned

properties.

4.It is further submitted that in the year 2021, petitioner's brothers viz., E.Sugumaran and E.Kumaravendhan made attempts to encroach the aforesaid properties. Therefore, petitioner filed a civit suit in O.S.No.68 of 2021 before the Additional District Munsif Court, Poonamallee for a permanent injunction restraining them from interfering with petitioner's peaceful possession and enjoyment of the suit property. The suit was decreed ex-parte in favour of petitioner. Thereafter, due to the advanced age of the petitioner, she executed a settlement deed in favour of her daughter dated 03.03.2025 in respect of the subject property.

5.Learned counsel for the petitioner further submitted that

petitioner submitted a representation dated 23.05.2025 to the respondents 1 and 2 seeking them to issue appropriate directions to 3 rd respondent to register the Settlement Deed dated 03.03.2025. The above representation has not been considered by the respondents till date. Aggrieved by the same, the present writ petition has been filed.

6.On this being pointed out, learned Government Advocate would submit that petitioner may re-present the Settlement Deed dated 3/6

03.03.2025, the same would be registered and released if it is otherwise in order. If for any reason, registration of settlement deed is sought to be refused, the respondents shall issue refusal slip/order assigning appropriate reasons, which was agreed to by the learned counsel for the petitioner.

7.In view thereof, the Writ Petition stands disposed of with a direction to the respondents to consider the representation dated 23.05.2025 and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner and any other interested parties/rival claimants, if any, within a period of 8 weeks from the date of receipt of a copy of this order and the respondent authorities shall register the Settlement Deed dated 03.03.2025 if it is otherwise in order. If for any reason, registration of settlement deed is sought to be refused, the respondents shall issue refusal slip/order assigning appropriate reasons. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. No costs.
