These Writ Petitions coming on for orders on this day and upon perusing the petition and the affidavit filed in support therof and upon hearing the arguments of Mrs.A.Ajimath Begum,Advocate for the petitioner in WP(MD)Nos.13997 and 15515 of 2024 and Mr.M.P.Senthil,Advocate for the Petitioner in WP(MD)Nos.20825 of 2024 and Mr.S.A.Ajmal Khan, Standing Counsel for the Respondents R1 & R2,and of for M/s.Ajmal Associates,for the Respondents,3 to 10 and of Mr.N.Mohideen Basha,Advocate Commissioner,this court made the following order:

Learned Advocate Commissioner/Election Officer had circulated a draft election notice dated 03.12.2021, setting out the following timelines for conduct of election in Kaniyakumari, Kottar, Ilankadai Muslim Samudhaya Trust.

2. It is submitted by the learned Advocate Commissioner that the time line for

conduct of election specified in the election notice may not be in conformity with the time line set out in the scheme decree dated 23.10.1973 which governs the Trust. However, inasmuch as the tenure of the present set of administrators is to end on 07.12.2024, both the counsel for the petitioners as well as respondents do not have

any objection in proceeding with the elections in terms of the timeline set out in the draft notice. The same is recorded.

3. The learned Advocate Commissioner would submit that the draft election

notice may have to be amended including prescribing non-refundable deposits to be

made by candidates. The draft election notice, which is circulated, may also be suitably amended, if needed, by the learned Advocate Commissioner.
