12.2. The time for completing the contract was fixed as ninety days in Ex.A1sale agreement. As already observed securing release deeds from the co-sharers was not the condition precedent for executing the sale deed. In fact, there is no recital that the properties mentioned in Ex.A1 belong to other co-sharers also. In any event, the plaintiff has issued the legal notice only after the expiry of ninety days. Thus, the plaintiff has not shown his readiness and willingness to perform his part of the contract. The balance sale consideration was not also deposited at the time of filing the suit by the plaintiff to show his readiness. The learned counsel for the appellant/plaintiff contended that, after the issuance of legal notice (Ex.A2), the defendants received a sum of Rs.50,000/- by way of a cheque as is seen from Ex.A3 receipt. He would therefore contend that time was not the essence of contract and therefore, it has to be held that the plaintiff was ready and willing to perform his part of the contract.
