The suit has been filed for infringement and passing off.
2.This application has been filed seeking leave to sue the first respondent/ first defendant. As seen from the plaint averments, the infringed products are being sold at Chennai by the second respondent/second defendant. In a reply sent to the Cease and Desist notice, the second respondent/second defendant has responded to the applicant/plaintiff stating that the first respondent/first defendant has been selling the infringed products to them. Since the infringed products have been sold at Chennai, a part of cause of action has arisen within the jurisdiction of this Court.
3.Accordingly, this application is allowed as prayed for. Registry is directed to number the suit if it is otherwise in order and list the same on 10.11.2023 along with the Interlocutory Applications.
