The petitioner / wife seeks transfer of proceedings in HMOP.No. 124 of 2019, on the file of Family Court, Ramanathapuram to the Family Court at Madurai. The said petition has been filed by the respondent / husband seeking divorce on the ground of cruelty under Section 13(1) (ia) of the Hindu Marriage Act, 1955.

The petitioner / wife seeks transfer on the ground that her life would be endangered if she goes to Ramanathapuram for every hearing. A copy of the First Information Report lodged by the petitioner / wife has also been produced before this Court.

Considering the facts and circumstances as well as the convenience of wife, I am of the considered opinion that the HMOP could be transferred to the file of the Principal Sub Court, Madurai, which is empowered to deal with the matrimonial matters, so that, the inconvenience caused to the respondent / husband substantially reduced as his personal appearance is not required before the Sub Court.

Accordingly, the Transfer CMP is allowed and HMOP.No.124 of 2019 pending on the file of the Family Court, Ramanathapuram, is withdrawn and transferred to the file of the Principal Sub Court, Madurai. The Family Court, Ramanathapuram is directed to transmit https://hcservices.ecourts.gov.in/hcservices/
