22.04.2016, thereby directed the respondent to consider the representation of

the petitioner dated 27.10.2015 and dispose the same on merits in accordance with law after giving opportunity of hearing to the petitioner as well as the Village Panchayat President of Marudur Village, Karamadai, Coimbatore District within a period of twelve weeks from the date of receipt of copy of the order.

Heard, Mr.B.Hari Krishnan, the learned counsel for the petitioner and Mr.P.Baladhandayutham, Special Government Pleader appearing for the respondent.

The Special Government Pleader appearing for the respondent submitted that as directed by this Court, the respondent herein initiated action on the representation of the petitioner and issued show cause notice to the Marudur Village Panchayat President under Section 205 of the Tamilnadu Panchayat Act, 1994. Thereafter, whatever the action taken by the respondent has been duly communicated to the petitioner by order dated 17.08.2016 in ROC.No.1439/2012/A3.

In the meantime, the term of the third respondent expired on 24.10.2016. Thereafter, the Government had appointed Block Development

execute the powers and discharge the function of the Village Panchayat vide

GO.(Ms).No.124 Rural Development and Panchayat Raj (PRI-I) Department dated 24.10.2016. Now Assistant Director of Rural Development (Audit), Coimbatore is empowered to issue surcharge certificate and now issued surcharge notice to the President of Marudur Village Panchayat.

Considering the above, the respondent is directed to complete the

surcharge proceedings as against the President of Marudur Village Panchayat in the manner known to law within a period of eight weeks from

the date of receipt of copy of this order.

With the above direction, this contempt petition is closed.
