Instant writ petition has been filed for a Writ of Mandamus, directing the Tahsildar, Edapadi Taluk, Salem District, namely the 5th respondent, to survey Mattampatti Primary & Government School land in Survey No.22/4A at Erumaipatti Village, Edappadi Taluk and thereby direct the respondents to construct a compound wall to its total extent pursuant to the petitioner's representation dated 9.5.2019.

2. Supporting the prayer sought for, petitioner has contended that he is a resident of Mattampatti village, Salem District. A government school is functioning in the name of Mattampatti Primary School and the same was established during 1990. As per government records, the same was clearly mentioned in Patta No.446. Construction of the compound wall was started in the above school, based on the order of the District Collector, Salem District, the 1st respondent. But the officials, with an intention to leave 8 meter land and well, which belonged to the above school are constructing the compound wall and the main reason for leaving 8 meters of the government land is to benefit some other adjacent land owners.

Hence, the petitioner has sent a representation to the respondents to survey the above land property and construct the compound wall without leaving a single meter to the adjacent land owner and thereby construct the compound wall to the total extent of the above school land. After receiving the representation, the District Collector, Salem District and the Chief Educational Officer, Salem District, namely the 2nd and 4th respondents, respectively, forwarded the same to the Tahsildar, Edappadi Taluk, namely the 5th respondent in Na. Ka. No.1029/2019 dated 15.5.2019 and Na. Ka. No.3364/E5/2018. But even after the receipt of the representation, the respondents did not take any effective steps to survey and construct the compound wall to its total extent. Hence, the petitioner has approached this Court by way of the instant writ petition.

4. Today, when the writ petition came up for admission, there was no representation for the petitioner. Hence the matter

was passed over. In the afternoon, when the matter was taken up again there is no representation for the petitioner.s

5. On the basis of the instructions contained in Na.Ka. No.770/2019/A2 dated 12.07.2019, Mr.Akhil Akbar Ali, learned Government Advocate, submitted that there is no encroachment in S. No.224/4B of Mattampatti Village, Edappadi Taluk, Salem District, where Mattampatti Primary School is functioning. Taking note of the safety of the children, compound wall of the School has been constructed excluding the well. Well is being maintained by Panchayat. Learned Government Advocate, has also produced necessary orders in this regard. 6. Contention that 8 ft. and a well is left in constructing the compound wall for the benefit of the adjacent land owner is denied. Whereas, it is only to ensure the safety of the children mala fide alleged is not substantiated.

7. In view of the same, writ petition is dismissed. No costs. Consequently, writ miscellaneous petition is closed.
