This appeal is preferred by the appellant Transport Corporation as against the award dated 13.02.2006 passed by the Motor Accidents Claims Tribunal, Sub Judge, Gudiyatham, in MACTOP No.124 of 2005.

The learned counsel for the appellant submitted that the appellant Transport Corporation agreed to satisfy the award passed by the Tribunal. In view of the same, the award of the Tribunal at Rs.3,87,000/-(Rupees Three Lakhs and Eighty Seven Thousand only) with interest at the rate of 6% per annum from the date of petition till the date of deposit, is hereby confirmed.

3.Hence, the appellant Transport Corporation is directed to deposit the entire award amount with interest and costs, after deducting the amount already deposited, if any, within a period of six weeks from the date of receipt of a copy of this award. On such deposit being made, the first respondent / claimant is permitted to withdraw his share. The shares of the minor claimants/ respondents 2 to 5 shall be deposited in any one of the Nationalized Bank, till they attain the age of majority and the father of the minor claimants/ first respondent is entitled to withdraw the accrued interest, once in three months. The Tribunal is directed to transfer the same to the respondents/claimants, on proper identification through RTGS in accordance with the terms of the award, without insisting on any formal permission petition.

4.Accordingly, the Civil Miscellaneous Appeal is disposed of.
