3.Counsel for the appellant further requests this Court to pass appropriate orders based on the abovesaid memo.

4.In the light of the above position, inasmuch as the Respondent/Plaintiff had died on 25.11.2012 and steps had not been taken by the counsel for the appellant to proceed further in the matter as per law, in such view of the matter, there is no purpose in keeping this First Appeal further pending.
