Second Appeal is preferred under Section 100 of the Code of
Civil Procedure, against the judgment and decree passed by the
Court of Additional Subordinate Judge, Tindivanam in A.S.No.26
of 2003 dated 31.10.2005 against the judgment and decree passed
by the Court of Additional District Munsif, Tindivanam in
O.S.No.430 of 1989 dated 28.6.2002.

J U D G M E N T
The learned counsel for the appellant made a submission
that on account of the subsequent developments occurred during
the pendency of the Second Appeal, the cause aroused became
vanished. Thus, the Second Appeal became infructuous and the
learned counsel for the appellant has also made an endorsement
to the said effect. Accordingly, the Second Appeal stands
dismissed as withdrawn. However, there shall be no order as to
costs.
