PRAYER: This Second Appeal is filed under Section 100 of Civil Procedure Code, praying against the judgment and decree dated 15.07.2003 in A.S.No.99 of 1998 on the file of Fast Track Court (Additional District Judge) Kancheepuram confirming the Judgment and decree dated 23.09.1996 in O.S.No.1417 of 1988 on the file of the Court of Principal District Munsif, Kancheepuram.

The learned counsel for the appellant would submit that subsequent to the suit in O.S.No.1417 of 1988 filed for permanent injunction, which is the subject matter of the Second Appeal. The suit in O.S.No.244 of 1997 on the file of the District Munsif, Kancheepuram, has been filed for recovery of possession and succeeded in it, the possession has also been taken by the appellant.
