ORDER : The Court Made the following order :-

The petitioner, who was arrested and remanded to judicial custody since 19.06.2018 for the offences punishable under Section 294(b), 302 of I.P.C. in Crime No.198 of 2018, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 18.06.2018 the petitioner attacked his own mother due to wordy quarrel and killed her by throwing grinder stone. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner was arrested and remanded in judicial custody on 19.06.2018. Now his elder son Mr.Hari Prakash died on 02.10.2018 by drowning in the river. Therefore, he has to do the funeral performances to his son. The learned counsel appearing for the petitioner submits that today namely 03.10.2018 at 05.00 pm., is fixed to perform the funeral rituals to the son of the petitioner. Therefore, he may be released on bail before 05.00 p.m.

4.The learned Additional Public Prosecutor would further submit that the petitioner attacked his own mother due to wordy quarrel and killed her.

involved in this matter, this Court is inclined to release the petitioner on bail without furnishing any surety. The petitioner is presently lodged in Central Prison, Madurai. Therefore, the Superintendent, Central Prison, Madurai is directed to release the petitioner immediately, after receipt of this order, without insisting any bail bond from the concerned Judicial magistrate. Thereafter, the petitioner is directed to appear before the learned Judicial Magistrate, Manamadurai on 08.10.2018 and shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Manamadurai and he shall appear before the respondent police daily at 10.30 a.m. until further orders from 08.10.2018.
