PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, directing the respondent Police not to harass the petitioners and their family members.

2.It is seen from the records that there is a property dispute pending between the parties and a complaint was also given before the Tahsildar, Tiruppur North, in this regard. The Tahsildar also conducted an enquiry and enquired the parties and on verification of records, the Tahsildar by an order dated 12.09.2018 dismissed the petition given by the neighbour namely Karthikeyan. Without challenging this order, the said Karthikeyan had approached the police and the petitioner is being prevented from putting the construction in his property.

3.The nature of dispute that has been projected in this case is purely civil in nature and the police will have no role to play in a case of this nature. The respondent police is directed to relegate the parties to the competent Court and the parties shall workout their remedy only before the competent
