Petition praying that in the circumstances stated therein the High Court will be pleased to vacate the interim order dated 05.09.2018 passed in Crl.M.P.No.11730/2018 in Crl.R.C.No.1002/2018.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.MA.GOUTHAMAN Advocate for the petitioner and of MR.V.NITHYANANDAM Advocate on behalf of the Respondent the court made the following order:-
This petition has been filed to vacate the interim order passed by this Court in Crl.M.P.No.11730 of 2018 in Crl.R.C.No.1002 of 2018, dated 05.09.2018.
(i) Earlier, this Court by its order dated 05.09.2018, has suspended the sentence of the accused on condition that the accused shall deposit a sum of Rs.4,50,000/- to the credit of S.T.C.No.968 of 2014, within a period of six weeks from the date of receipt of a copy of the order.
(ii) Subsequently, the accused filed an application in Crl.M.P.No.14752 of 2018, seeking extension of time for complying with the condition imposed by this Court vide order dated 05.09.2018. After hearing the submissions of the learned counsel for the accused/petitioner therein, this Court has directed the petitioner therein to deposit the amount of Rs.4,50,000/- within a period of four weeks from 05.11.2018.
3. When the matter is taken up for hearing today, a memo of compliance has been filed on behalf of the accused stating that the above condition imposed by the Court has been complied with. https://hcservices.ecourts.gov.in/hcservices/
4. The compliance is hereby recorded. The vacate stay petition is closed. The substantive sentence of imprisonment shall remain suspended, if the petitioner has executed a bond for a sum of Rs.10,000/- with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, (FAC), Krishnagiri.
