This Petition is filed under Article 226 of the Constitution of India to appoint advocate commissioner to inspect Aththikulam Kanmai situating in aththikulam Village, Thiruchuli taluk, Virudhunagar district and for record statements from the village of Aththikulam village and file report relating to the sand and gravel taken from the said kanmai before this Honble Court within the time stipulated by this Honble Court.

This Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the Respondent No. 2 to take immediate action on the basis of the letter of the respondent No. 1 in Na.Ka.Kevi 1/29680/2015 dated 09.10.2015 and on the basis of the representation submitted by the petitioner dated 16.10.2015 within the time stipulated by this Honble Court.

This Petition coming on for hearing on this day, upon perusing the petition and the affidavit filed in support thereof and the earlier order of this court and upon hearing the arguments of Mr.R.Alagumani, Advocate for the petitioner and of Mr.M.Govindan, Special Government pleader on behalf of the Respondents, this Court made the following order.

This petition has been filed praying to appoint an Advocate https://hcservices.ecourts.gov.in/hcservices/ Commissioner to inspect Aththikulam Kanmai situates in Aththikulam Village, Thiruchuli Taluk, Virudhunagar District.

2.It is averred in the petition that from Aththikulam Kanmai some private parties/contractors without obtaining proper order, have taken soil and thereby created huge pits. Under the said circumstances for noting down the physical features, appointment of Advocate Commissioner is essential and therefore the present petition has been filed.

3.Considering the purpose mentioned in the petition, this Court is inclined to appoint an Advocate Commissioner.

4.In fine, Advocate M/s.T.Sathya Selvi, No.89, Law Chambers, High Court Buildings, Madurai is appointed as Commissioner and her fee is fixed at Rs.5,000/- [Rupees five thousand only] and the same should be paid directly by the petitioner. The Advocate Commissioner is directed to inspect the place mentioned in the petition after giving due notice to both parties.
