The writ petition has been filed praying this Court for issuance of a Writ of Mandamus directing the respondents to grant permission to conduct the "Adal Padal" dance programme on 27.04.2014 from 10.00 p.m. to 01.00 a.m. in pursuance to the festival of the Arulmigu Paalathu Mahamariyamman Thirukovil" situated in Musiri, Trichy District.

2.By consent, the writ petition itself is taken up for final disposal.

3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.

4.In the affidavit, it has been stated that the petitioner belonged to the Musiri Town Panchayat and near to the old bus stand of Musiri, there is a temple called "Arulmigu Paalathu Mahamariyamman Thirukovil" is situated. Every year in the Tamil month of Chitirai, festivals will be conduced in a very grand manner for generations and even the neighbouing people would also come and participate in the festival and he is the head of the Festival Committee. Chitrai festival for this year is schedule to be held on 12.04.2014 and they proposed to conduct cultural activities, traditional songs and dance on 27.04.2014. Hence, they approached the second respondent for permission, but the second respondent refused to give permission to conduct cultural activities on 27.04.2014. Therefore, the Petitioner has come forward with the present Writ Petition.

5.Today when the matter is taken up for hearing, the learned Government Advocate submitted that on an earlier occasion, this Court by accepting the submission of the learned Government Advocate, imposed 23 https://hcservices.ecourts.gov.in/hcservices/ conditions to conduct drama and if the same conditions are imposed the second respondent will consider the application of the petitioner. The condition imposed by this Court on an earlier writ petition is as follows:

The learned counsel appearing on behalf of the petitioner submits that he would abide by all the above said 23 conditions, which are enumerated by the second respondent Police.

In view of the submission made by the learned Government Advocate, this Court directs the second respondent to grant permission to conduct "Adal Padal" dance programme on 27.04.2014 by using box speakers with low decibel sound and by imposing the above said conditions. Further, this Court directs the second respondent police to pass necessary orders on 25.04.2014, incorporating the conditions as enumerated above.

The writ petition is disposed of with the above directions. No costs.
