Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent to consider the application of the petitioner dated 09.05.2014 to sanction Educational Loan of a sum of Rs.3,90,000/- to the petitioner towards 4^th and 5^th year fee amount to pursue the course of Bachelor of Medicine and Bachelor of Science (MBBS) within a stipulated time.

The petitioner seeks for a direction to consider his application dated 09.05.2014 to sanction educational loan of Rs.3,90,000/- to the petitioner to enable him to complete the five year MBBS course at China.

2.The petitioner has produced all the documents to establish that he is studying MBBS course in Dali University in China. The respondent bank has kept the application pending and requested for certain clarification.

3.According to the petitioner, he has produced all records to establish that the petitioner is studying in a recognized institution and also produced Eligibility Certificate issued by the Medical Council of India. Despite these records, the application was kept pending. Therefore, the petitioner has come forward with this writ petition for the above said relief.

4.The respondent bank filed counter affidavit stating that the petitioner has produced a progress report to show the marks obtained by the petitioner and the same has not been issued by the University, but it is a progress report, issued by one Saraswathi online. Com India Limited. Therefore, it is stated that the respondent bank was unable to verify the genuineness.

5.The learned counsel for the petitioner submitted that in respect of all the students, who are studying in the said University, the progress

report is given in Chinese language and Saraswathi online.come India Limited is one such company who are authorised to translate and issue certificate as regards the progress report of the candidates, who are studying in China and pursuing MBBS decree. Further it is submitted that in respect of another claim of M.Dharaniya, who is also studying in the same University and doing MBBS course, the Indian Overseas Bank, Sathanur Branch, Trichirapalli has sanctioned the Educational Loan in account No.951100043. It is further submitted that the said Dharaniya also produced the progress report as given by the Saraswathy online.com India Limited, which is a translated version of the progress report of the candidate issued in chinese language.

6.In the light of the above, the petitioner is directed to produce a letter from Saraswathi online.com India Limited stating the progress report given to the petitioner is the true translated version of the chinese version which has been given by the Dali University and on production of such letter, the respondent bank shall verify the details and if necessary can also seek for information from Indian Overseas Bank, Trichirapalli and thereafter, process the petitioner's application for grant of educational loan within a period of four weeks from the date of which the petitioner produces the letter as directed above from Saraswathi online.com India Limited. Writ Petition is disposed of accordingly. No Costs.
