PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents 1 to 3 to measure new S.No.103/8 = old No.175/3 Ac.1.29 in Vilangalpattu Village, Cuddalore Taluk, Cuddalore District in the presence of the petitioner and the fourth respondent, find out the erosion by odai in their respective portions, assign separate survey numbers and consequently issue separate pattas for the respective extents in the possession of petitioner and fourth respondent.

The petitioner has come up with the above writ petition seeking a direction to the respondents to conduct a survey, fix the boundaries and issue separate pattas after sub-division, both in the name of the petitioner as well as in the name of the fourth respondent.

Heard Mr.R.Gururaj, learned counsel for the petitioner. Mrs.M.E.Rani Selvam, learned Additional Government Pleader takes notice for the respondents.

The petitioner claims that he and the fourth respondent own 1.29 acres in total in old S.No.175/3. After re-survey, the lands, which fell to the share of the petitioner and the fourth respondent, were assigned with new survey Nos.103/8B and 103/8A respectively. Though the patta was issued in favour of the fourth respondent for 64 1/2 cents, only a joint patta was issued in the name of the father of the petitioner and one Chinnammal that too for an extent of 25 cents. Therefore, seeking to conduct a survey in respect of the entire new S.No.103/8 comprising of 1.29 acres and for the issue of a separate patta both in the names of the petitioner as well as the fourth respondent after proper sub-division, the petitioner sent a representation dated 14.10.2014 to the respondents 1 to 3. Since it did not evoke any response, the petitioner is before this Court.

Considering the limited nature of the prayer sought and without expressing any opinion on the merits of the case, the writ petition is disposed of with a direction to the second respondent to consider the representation of the petitioner dated 14.10.2014 on merits and if the pattas stand in the names of the petitioner as well as the fourth respondent and if there are no disputes with regard to ownership, take appropriate action in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
