O R D E R

The petitioner has come up with the above writ petition seeking the issue of a writ of mandamus to Respondents 2 to 5 to reclassify the land and issue patta in his name for the land measuring 1.19.5 Hectares or 2 Acres and 65 Cents comprised in S.No.26/2 and situated at Kozhavur Village, Polur Taluk Thiruvannamalai District by considering his representation dated 18/09/2014 sent to the Respondents.

2.Heard Mr.G.Issac William, learned counsel appearing for the petitioner. Mrs.M.E.Rani Selvam, learned Government Advocate takes notice for the respondents.

3.The petitioner, aged about 90 years, has made a representation dated 18.09.2014, seeking to grant patta in his name for the aforesaid land. Though the aforesaid land has been classified in the Land Register as "Kuttai" poromboke, there was neither any "Kuttai" nor any stagnation of water for the past 70 years. He was cultivating in the land and he has been paying regularly possession and cultivation fee to the Government from the year 1963 onwards. Even the Revenue Inspector has collected all the details and submitted a report in favour of the petitioner, to the Tahsildar for recommending to the Collector for the issuance of patta in his name. Since no action has been taken, he has come up with the above Writ Petition.

4.Considering the facts and circumstances of the case, this writ petition is disposed of, directing the respondents to consider the representation of the petitioner dated 18.09.2014 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. However, the respondents shall not pass any order contrary to the provisions of Tamil Nadu Protection of Tanks Act. No costs.
