Prayer:- Petition has been filed under Section 24 of C.P.C., praying to withdraw the case in H.M.O.P.No.466 of 2013 on the file of Subordinate Court, Poonamallee and transfer the same to the SubCourt, Kovilpatti to be tried along with HMOP No.45 of 2014.
The petitioner herein, who is the respondent in H.M.O.P.No.466 of 2013, has filed this petition seeking transfer of H.M.O.P.No.466 of 2013, from the file of the Subordinate Court, Poonamallee, to the file of the learned Sub-Court, Kovilpatti to be tried along with H.M.O.P.No.45 of 2014.
- The learned counsel appearing for the petitioner submitted that the respondent herein, who is the husband of the petitioner herein, filed H.M.O.P.No.466 of 2013, on the file of Subordinate Court, Poonamallee, for divorce on the ground of cruelty, whereas, the petitioner herein, who is the wife of the respondent herein, filed H.M.O.P.No.45 of 2014, on the file of the Sub-Court, Kovilpatti for restitution of conjugal rights. He further submitted that to avoid multiplicity of proceedings and conflicting judgments by the Court, the case pending in H.M.O.P.No.466 of 2013 on the file of Subordinate Court, Poonamallee may be directed to be transferred to Sub-Court, Kovilpatti to be tried along with H.M.O.P.No.45 of 2014. Further, the counsel submitted that to attend the case in H.M.O.P.No.466 of 2013, the petitioner/wife has to travel 500 kilometers and hence, she finds difficulty to attend the Court each and every hearing before the Subordinate Court, Poonamallee and further having the child admitted at Vellammal, https://hcservices.ecourts.gov.in/hcservices/ School, at Chennai and because of difference of opinion, the child
