ORDER : The Court Made the following order :-

The petitioner/A5, who was arrested on 28.08.2014 for the alleged offence under Section 399 I.P.C in Crime No.468 of 2014 on the file of the respondent police, seeks bail.

Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the State and also perused the materials available on record.

The learned counsel for the petitioner submitted that the petitioner is in judicial custody for more than 42 days and coaccused in this case have already been released on bail and hence, the petitioner may be released on bail.

The learned Government Advocate submitted that charge sheet is not yet filed.

Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail on the following conditions.

Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Eraniel, Kanyakumari District, and on further condition that the petitioner shall appear before the concerned Magistrate Court at 10.30 a.m until further orders.
