PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner, who is arrayed as A4, in C.C.No.7 of 2014 apprehends arrest at the hands of the respondent in pursuance to the warrant issued by the Special Court, constituted to try the offence under the TANPID Act, on 07.07.2014.

The learned counsel for the petitioner submitted that the respondent registered the case in the year 2007 against Akilam Bankers and its proprietor Thulasi @ Ramakrishnan and the trial had also commenced in that case in 2007 itself. But subsequently, after the death of the proprietor, the respondent filed an additional charge sheet impleading the petitioner as one of the accused in this case.

The learned counsel for the petitioner further submitted that the petitioner was working as a Manager of the Akilam Bankers and he resigned his job in the year 2004 itself and thereafter, only in the year 2007, the case has been registered against the said Akilam Bankers. It is further submitted that the petitioner was not at all aware of the case filed in the year 2007 and there is no material to implicate the petitioner in this case.

Heard the learned Government Advocate (crl. side).

Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Special Judge, Tamilnadu Protection of Interest Depositor's Court, Madurai and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with https://hcservices.ecourts.gov.in/hcservices/ two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the learned Special Court whenever his presence is

required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
