ORDER : The Court Made the following order :-

The petitioner is the sole accused and he was arrested and remanded to judicial custody on 14.06.2014 for the alleged offences punishable under Sections 380, 511 of IPC and section 3 of TNPPDL Act, in Crime No.176 of 2014 on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that the accused had attempted to commit theft by breaking the door of an ATM machine.

3.The learned counsel appearing for the petitioner submitted that only on suspicion, the petitioner was arrested and the petitioner hails from Nepal and he was employed by the villagers of Palayakayal village as Night watchman and he has been falsely implicated in this case. He further submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution

4.The learned Government Advocate (Criminal side) submitted that the petitioner has no bad antecedents and major part of the investigation is over.

5.Considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruchendur, Thoothukudi District and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m. for a period of two weeks and thereafter as and when required for interrogation.
