ORDER : The Court Made the following order :-

The petitioner is the sole accused and he was arrested and remanded to judicial custody on 16.06.2014 for the alleged offences punishable under Sections 294(B), 341, 302 and 506(ii) of IPC @ 294(B), 302 and 211 of IPC, in Crime No.114 of 2014 on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that the accused suspected the fidelity of his wife and therefore, they were living separately for the past seven years, but having wounded by the adverse commends, the accused murdered his wife on 12.06.2014.

3.The learned counsel appearing for the petitioner submitted that the case was registered on the complaint given by the petitioner against the paramour and subsequently, the petitioner has been implicated on the ground that the petitioner has admitted his guilt in the extra-judicial confession given before the Village Administrative Officer.

4.The learned counsel appearing for the petitioner further submitted that the petitioner is taking care of his two children and the entire investigation is over. He further submitted that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution.

5.The learned Government Advocate (Criminal side) appearing for the respondent submitted that major part of the investigation is over and the respondent has to file the charge sheet.

6.Considering the fact that the petitioner has been incarceration https://hcservices.ecourts.gov.in/hcservices/ for more than 75 days and the major part of the investigation is over, this court is inclined to enlarge the petitioner on bail with certain conditions.

7.Accordingly, the petitioner is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Sathankulam, Tuticorin District and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m. until further orders.
