ORDER : The Court Made the following order :-

The petitioner is the sole accused and he was arrested and remanded to judicial custody on 29.12.2013 by the respondent Police for the alleged commission of offences under Sections 376 and 420 of I.P.C., in Crime No.19 of 2013 on the file of the respondent Police and the offences were said to have been committed one month prior to 29.12.2013.

The case of the prosecution is that the victim girl is aged about 23 years and she developed intimacy with the accused and later on it become love affair and the petitioner under the guise of marrying her, had physical relationship and when the victim girl insisted for marriage, he refused to marry her.

The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated on account of previous enmity and even assuming without admitting that the allegations in the FIR are true, still the ingredients of the offences are not made out and hence, prays for bail.

The learned Government Advocate (crl.side) has produced the statement of the victim girl as well as the medical report and would submit that chemical analysis report is awaited

5.This Court has also gone through the statement of the victim girl as well as the Accident Register and considering the nature of the allegations, facts and circumstances and the period of incarceration, is inclined to enlarge the petitioner on bail with certain conditions. https://hcservices.ecourts.gov.in/hcservices/ Accordingly, the petitioner is directed to be released on bail on executing a personal bond each for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction

of the learned Judicial Magistrate No.IV, Trichy and on further condition that the petitioner shall Stay at Tiruvannamalai and appear before the Tiruvannamalai Town Police Station daily at 11.00 a.m., until further orders.
