JUDGMENT
A perusal of the records reveals that the second appeal has been referred to Lok Adalat for settlement, but both parties were not turned up for seven times. Therefore, the said second appeal was returned back to this Court.
2.When the matter was taken up for hearing on 2.12.2013, there was no representation on the side of the appellant as well as the respondent. Hence, it was directed to be posted under the caption 'for dismissal' on 6.12.2013. In spite of it, today also there was no representation on the side of the appellant and the respondent either in person or through counsel. Therefore, the
second appeal is dismissed for non-prosecution. There is no order as to costs.
