PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioners, who are arrayed as accused, filed this petition pray for the grant of anticipatory bail under Section 438 of Cr.P.C. for alleged offences punishable under Sections 294(b), 341, 324, 506(ii) of IPC in Crime No.223 of 2013 on the file of the respondent police.

The learned counsel for the petitioners submitted that a criminal case as against the petitioners/A1 and A3 and one another in Crime No.223 of 2013 was registered by the respondent police.

The learned counsel for the petitioners further submitted that injured has been discharged from hospital and co-accused was arrested and released.

The learned Government Advocate also admitted that injured was discharged from hospital.

Considering the nature of offence alleged to have been committed by the petitioners and other factors and considering the https://hcservices.ecourts.gov.in/hcservices/ fact that injured has been discharged from hospital,I am inclined to grant anticipatory bail to the petitioners, with certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Aruppukkottai, Virudhunagar District on each of them executing a separate bond for a sum of Rs.10,000/(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
