PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioners pray for the grant of anticipatory bail under Section 438 of Cr.P.C for offences punishable under Sections 120-B, 294(b), 341, 427 and 506(ii) of IPC on the file of the respondent police in Crime No.513 of 2013.

Learned counsel for the petitioners submits that the petitioners are innocent persons and they have not committed any offence.

3.Learned Government Advocate (Crl. Side) submits that no one sustained injury.

On consideration of the facts and circumstances of the case and considering the submissions made, this Court is of the view that the petitioners can be granted the relief prayed for and accordingly;

(a) In the event of arrest by or on appearance before the respondent police;

¶17

(b) In the event of appearance before the learned Judicial Magistrate, Valliyoor within 15 days form the date of receipt of copy of the order

¶18

(i) the petitioners shall be enlarged on bail on each of them executing a bond for Rs.10,000/-(Rupees Ten Thousand Only) with two sureties for the like sum to their satisfaction;

¶19

(ii)the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of https://hcservices.ecourts.gov.in/hcservices/ the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer;

(iii)the first petitioner shall be available for interrogation by the respondent police daily at 10.00 a.m., for two weeks and thereafter as and when required and the petitioners 2 and 3 shall appear before the respondent police as and when required for interrogation.
