PETITION FOR Anticipatory BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner apprehends arrest at the hands of the respondent police for alleged offences punishable under Clause 6(2)(3)(4) of TNSC (RDCS) Order 1982 r/w 7(1)(a)(ii) of Essential Commodities Act, 1955 in Crime No.418 of 2013 on the file of the respondent police and hence, he has come forward with this petition seeking anticipatory bail.

Learned Counsel for the Petitioner submits that the petitioner is an innocent person and he is nothing to do with the alleged commission of offence.

Heard the learned Government Advocate (Criminal Side) on the submissions made by the learned Counsel for the Petitioner.

On consideration of the facts and circumstances of the case and the submissions made, this Court is inclined to grant anticipatory bail to the petitioner and accordingly,

(a) In the event of arrest by or on appearance before the respondent police;

¶18

(b) In the event of appearance before the learned Judicial Magistrate No.III, Madurai within 15 days from the date of receipt of copy of the order;

¶19

(i) the petitioner shall be enlarged on bail on executing a bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each for the like https://hcservices.ecourts.gov.in/hcservices/ sum to the satisfaction of the learned Judicial Magistrate concerned;

(ii) The petitioner shall deposit a sum of Rs.3,000/- (Rupees Three Thousand Only) to the credit of Crime No.418 of 2013, on the file of the Judicial Magistrate No.III, Madurai; and

(iii) The petitioner shall appear before the respondent police daily at 10.30 a.m for a period of two weeks and thereafter as and when required.
