PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner prays for the grant of anticipatory bail under Section 438 of Cr.P.C. for the offence punishable under Section 366 (A) IPC, on the file of the respondent police.

The case of the prosecution is that the de-facto complainant's adopted daughter, namely, Alka Theerisia Sarojini aged about 17 years was kidnapped by the petitioner on 30.4.2013. On the strength of the complaint lodged on 1.5.2013, the respondent police registered a case for the above said offence against the petitioner.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) for the respondent.

Considering the contention of the learned counsel for the petitioner that due to enmity, a false case has been registered and the Girl has been secured and now, is with the parents, this Court is of the view that the petitioner can be granted the relief prayed for and accordingly;

(a) In the event of arrest by or on appearance before the respondent police;

¶18

(b) In the event of appearance before the learned Judicial Magistrate, Valliyoor, within 15 days from the date of receipt of copy of the order,

¶19

(i) the petitioner shall be enlarged on bail on his executing a bond for Rs.10,000/-(Rupees Ten Thousand Only) with two sureties for the like https://hcservices.ecourts.gov.in/hcservices/ sum to their satisfaction;

(ii) The petitioner shall be available for interrogation by the

respondent police daily at 5.30 p.m. for two weeks and thereafter, as and when required for interrogation.
