The petitioner is before this Court seeking to direct the respondents to process Ext.P5 application for reissuance of his Passport and for changes in the existing personal particulars, within a time frame fixed by this Court.

Ext.P5 is a Passport application stated to be submitted by the petitioner. The petitioner wanted change in the particulars in the Passport, including date of birth and residential address. The petitioner submits that the application is still pending and the respondents are not acting thereon.

Deputy Solicitor General of India resisted the

writ petition filing a statement and additional statement. In the additional statement dated 07.02.2024, it has been disclosed as follows:-

“2. It is submitted that no Passport reissue application submitted by the petitioner is pending before the RPO, Kozhikode. As per Ext.P6 in the writ petition, the petitioner had taken an online appointment to submit his Passport reissue application at Passport Seva Kendra, Vadakara on 30.08.2023 at 3:45 pm. However, as per the system records, he was marked as absent on that date as he has not submitted his signed Passport reissue application form (in the prescribed format) at that officer, and therefore no file number has been generated in the system.

It is further submitted that the Application Reference Number in the appointment receipt is valid for one year from payment of application fees. Hence, the petitioner can, as per his convenience, reschedule a new date through the official website and submit his signed Passport reissue application on that day along with the prescribed documents. On submission of his application, the RPO will consider it on its merits and pass appropriate orders in accordance with extant guidelines and statutory rules governing the matter.”

In view of the stand so taken by the respondents, it would be only appropriate that the

petitioner approaches the Regional Passport Officer. On the petitioner approaching the Regional Passport Officer with necessary documents, the Regional Passport Officer shall take a decision in accordance with law within a period of one month therefrom.
