WP(C)No.20065 of 2022 is filed seeking a

¶57

direction to the 5^th respondent District Collector to identify the land assigned for Family Welfare Centre on the basis of the records maintained by the 2^nd respondent Village Officer.

It is averred in the said writ petition that

¶59

the petitioner's father was a manager of a factory owned by his uncle Shri.George Peter. The parents of Shri.George Peter has given 15 cents of property to the Panchayath free of cost for starting a Public Health Centre. Before this transaction happened and even before the Independence of India, George Peter has assigned 34 cents of land behind the property assigned to the Public Health Centre in favour of the petitioner's father and the petitioner's father has constructed a residential

building in the said property even before the

Independence and thereafter, the petitioner and his family are residing in the said house. Even though 15 cents of land has surrendered as free of cost to the Health Department, the department is using only 3.80 Ares and constructed a Family Welfare Centre therein. Before the assignment of the said land, petitioner's family used to reach the public road through that property. It is further contended that during 1979, heirs of George Peter registered the said 34 cents of land in favour of the petitioner's

father, but unfortunately there was a mistake in recording the extent of land, though the measurement has been accurately mentioned in the deed. Subsequently, the petitioner's father gave the property to his eldest son, the brother of the petitioner in 1994 and thereafter the said property was assigned in the name of the petitioner and thereafter he is using the same as a residential property. It is further averred that subsequently the grand son of George Peter has trespassed into the property assigned for public Health Centre and

constructed a temporary fencing prohibiting the petitioner from entering into his house through the main gate. Thereupon, the petitioner approached the authority concerned. As per Ext.P1, the local authority informed the petitioner that necessary measurement has to be done by the revenue department. Thereupon, the petitioner submitted a request before the Tahsildar (LR), Cherthala, the 3^rd respondent herein for identifying the puramboke land having an extent of 15 cents in Survey No.92/9-1 of Kodamthuruth Village. By Ext.P2 proceedings necessary direction was issued to measure the property and determined the property which has been surrendered for the Family Planning

Centre. Petitioner relies on Ext.P3, relevant records of the said land issued by the Village Officer, Kodamthuruth to show that 15 cents of land comprised in Survey No.92/9-1 was relinquished for the Family Planning Centre as per order No.B1421/70 dated 09.01.1970. Petitioner contended that inspite of identifying the puramboke land respondents 1 and

2 are not taken any steps to remove the

encroachment upon the puramboke land. Since no

¶70

action was taken, the petitioner approached the 4^th respondent, RDO, Alappuzha to take appropriate action against the unauthorised use and trespass of

the public property. The 4^th respondent after verifying the matter directed respondents 1 and 3 to take immediate action for demarcation of the public property from the unauthorized occupation as per Exts.P6 and P7 proceedings. In spite of the same, no action has been taken by the respondents 1,2 and 6 to identify the puramboke land and its

trespass. In the said circumstances, the petitioner has approached this Court.

When the matter came up for consideration earlier, this Court as per order dated 5.7.2022 issued a direction to the 5^th respondent to identify the land assigned for the 6^th respondent and the property that belongs to the Family Welfare Centre

in Kodamthuruth Village in Survey No.92/9-1 extending to 6.07 Ares of land. Consequently, the Taluk Survey authority conducted a detailed investigation and survey and demarcated the land

allotted for Family Health Centre having an extent of 6.07 Ares and directed the local authority to take steps to evict the encroachment.

A Counter affidavit has been filed by the 1^st respondent specifically contending that any action for evicting the encroachment can be taken only when the extent of the encroached puramboke is identified by the survey authority.

Respondents 9 to 12 got impleaded as

additional respondents in the writ petition and filed a detailed counter affidavit. They have

¶80

denied the contention of the petitioner that the

¶81

father of George Peter has given 15 cents of

¶82

property to the Panchayath as free of cost for starting a public health centre. They contend that

¶83

the mode of said transfer or the date of said transfer or any other relevant details of the

¶84

alleged transfer were not disclosed by the

¶85

petitioner in the writ petition. It is further stated that George Peter has assigned 34 cents of

¶86

land behind the property assigned on the public

¶87

health centre in favour of the petitioner's father

¶88

even before the independence of India is also a false statement. In fact the grand father of the respondents, George Peter has executed a settlement deed bearing No.2313/1952 of Arookutty SRO in

favour of all his sons including the respondents father, Peter Immanuel. Therefore, the contention that the respondents' grandfather had assigned 34 cents of property to the father of the petitioner is absolutely without any basis. It is contended that the writ petitioner is having property on the eastern and southern side of the respondents property which was purchased by the father of the petitioner from the father of the respondents' Sri.Peter Emmanuel and his brothers and the extent of the property is only 22 cents. They further contend that the extent of property now held by the petitioner is about 34 cents and there are no documents evidencing the transfer of the said

extent of land to the father of the petitioner. It is only to validate his encroachment of the nearby

properties, he wants to make necessary modifications in the revenue records. In fact the

¶93

Family Health Centre was started and functioning on

¶95

the southern portion of the large extent of

¶96

property belonging to the respondents and permission was granted for such construction on a temporary basis and on the understanding that the building would be demolished at their cost on the request made by the respondents and permission was given to construct a building in an extent of 4 cents of property and further that there is no relinquishment of 15 cents of property or any other property belonging to the grandfather of the petitioner and any property in favour of the health department. As per Exts.R9(a), R9(b) and R9(c), the Primary Health Centre Vallathodu, Taluk Office Cherthala and Sub Collector, Alappuzha respectively had submitted that no records are available with them evidencing any relinquishment of property in respect of the above 15 cents of property comprised in Survey No.92/9-1. The intention of the writ petitioner is to create a road into his property, it seems that the interested persons with the connivance of the employees in the Village Office

of Kodamthuruthu Village managed to create

fraudulent entries in the basic tax records and

¶100

other documents and made wrong entries to the effect that a relinquishment of the immovable

¶101

property was granted in favour of the Health Department. Further it is the contention that the grandfather of the petitioner has relinquished 15 cents of property to the Panchayath as free of cost for starting a primary health centre is without any basis. In Ext.P3 it is seen that the relinquishment was done on 19.01.1970 whereas the grandfather of the respondents died on 3.4.1967 and therefore, the entries in the BTR and other records regarding the relinquishment has been made fraudulently by the interested persons subsequently. In respect of the property covered in Survey No.92/9-1 the respondents have already filed a suit as O.S.No.326/2018 before the Munsiff Court, Cherthala

for declaration of title of the property comprised in Survey No.92/9-1 in which the petitioner is a defendant and the Civil Court has passed Ext.R9(g) interim order in the said suit restraining the

respondent and his men and agents until further

¶105

orders from further trespassing into item No.1 property and from constructing road through it. Petitioner submits that it is suppressing all these facts and without impleading them as a party that the present writ petition has been filed and the

same is without any bonafides, and further submitted that without bringing out all these aspects to the notice of the court that the court has issued an interim order on 5.7.2022 to measure

¶107

and demarcate the property and therefore, he has

¶108

also sought for recalling the said interim order.

WP(C) No.9064 of 2023 is filed by the

¶110

respondents 9 to 12 in WP(C) No.20065 of 2022

¶111

praying for an order challenging Ext.P4, which is produced as Ext.P10 in the other writ petition. Petitioner also sought for setting aside the

¶112

entries in Ext.P8 relating to the alleged

¶113

relinquishment of the property comprised in Survey No.92/9-1 of Kodamthuruthu Village and also sought

¶114

for an enquiry by the 5^th respondent with the said

¶115

entries regarding the alleged relinquishment. In

¶116

the said writ petition, the petitioners have reiterated the contention taken in the counter affidavit filed in WP(C) No.20065/2022.

Petitioners also submit that the entries in Ext.P8 is suspicious in as much as the survey number is seen recorded in an ascending order and the ascending sequence of recording the survey number has been violated only in respect of Serial No.31

and it would show that the entry in Serial No.31 is subsequently incorporated. It is also the

¶120

contention of the petitioners that Serial No.31 in

¶121

Ext.P8 puramboke register concerning Survey No.92/9-1 is written in a different handwriting and in the remarks column the details of the alleged proceedings, No.B1421/70 dated 9.1.70 is

¶122

incorporated. It is also contended that it is not known which authority had issued the proceedings and on enquiry conducted by the petitioners they are informed that no such proceeding is available. It is further contended that by Ext.P15 document the extent of the land transferred to the father of the petitioners is only 22 cents and the contention

that they are in possession of 34 cents of land is absolutely without any basis.

I have heard the rival contention on both sides.

The conduct of the petitioner in WP(C)

¶127

No.20065 of 2022 in not impleading the necessary

¶128

parties, who are the petitioners in the other writ

¶129

petition as WP(C) No.9064 of 2023 is totally

¶130

unacceptable, especially when there is a specific averment in the writ petition that the grandson of Mr.George Peter had trespassed into the property assigned for public health centre and constructed a temporary fence prohibiting the petitioner from entering into his house through the main gate. Though it is averred in the writ petition in WP(C) No.20065/2022 that an extent of 15 cents of land was relinquished to the Government for construction of a Family Health Centre, no documents have been

produced to show that the property was infact relinquished to the Panchayath for construction of a Public Health Centre. The documents produced as

Exts.R9(a) to Ext.R9(c) would reveal that no

¶133

documents are available with the authorities to

show that 15 cents of land has been relinquished

¶136

for construction of the Family Health Centre. Yet another aspect to be considered is the contention

¶137

of the counsel for the petitioner in WP(C) No.20065/2022 that parents of George Peter have

¶138

given 15 cents of property to the Panchayath for starting a Public Health Centre. The proceedings of relinquishment even as per the entries in Ext.P8 is dated 9.01.1970 and the grandfather of the petitioners, George Peter had in fact died on

¶139

3.4.1967 as is evident from Ext.P9 certificate

¶140

issued by the Parish Church Register. On the basis of the same it is contended the averment that the

¶141

grandfather of the petitioners in WP(C) No.9064/2023 has relinquished 15 cents of property

¶142

to the Panchayath is absolutely without any basis.

Even though a perusal of Ext.P3 in WP(C)

¶144

No.20065/2022 would show that there is a

¶145

proceedings issued as B1421/70 dated 9.1.1970 to the effect that an extent of 15 cents of land in Survey No.92/9-1 has been relinquished for starting

a Family Planning Centre, no such order is

¶148

forthcoming either from the petitioners in WP(C)

¶149

No.9064/2023 or from any of the official respondents. Even though the petitioner in WP(C) No.20065/2022 would contend that the petitioners' father was assigned 34 cents of land even before the Independence, as per Ext.P15 produced in WP(C) No.9064/2023 the actual extent of property is only 22 cents. It is also to be noted that alleging encroachment upon the property, the petitioners in WP(C) No.9064/2023 has preferred OS No.326/2018 which is pending before the Munsiff Court, Cherthala and that Ext.R9(g) injunction has been granted against the petitioner in WP(C) No.20065/2022.

After hearing the learned counsel appearing on both sides, and also the learned Government Pleader, I am of the view that the issue regarding the relinquishment of 15 cents of land and Ext.P3 register produced in WP(C) No.20065/2022 showing that an extent of 15 cents of land in Survey No.92/9-1 has been relinquished for a Family

Planning Centre as per proceedings No. B1421/70 dated 9.1.1970 has to be enquired into by a higher authority.

Therefore, the above writ petitions are

disposed of with a direction that the 5^th respondent shall conduct an enquiry into the said aspect and take a final decision in the matter after affording an opportunity of being heard to the petitioner in WP(C) No.20065/2022 and also the respondents 9 to 12, who are the petitioners in WP(C) No.9064/2023. The petitioners in WP(C) No.9064/2023 shall make an

appropriate request in this regard before the 5^th respondent within a period of 3 weeks from the date of receipt of a copy of the judgment and the 5^th respondent shall take appropriate decision on the same, after affording an opportunity of being heard as directed above. Till a decision is taken as directed above, the interim order granted by this Court on 16.3.2023 in WP(C) No.9064/2023 shall continue to be in force. The 5^th respondent while taking a decision as directed above, shall also take into consideration the pendency of civil suit
