JUDGMENT
Being aggrieved by the initiation of revenue recovery proceedings
to recover the award amount in O.P.(MV) No.1630/2015, the petitioner is before this Court with this writ petition.
a) The Indus Motor Co.Ltd., the petitioner herein, is the authorized dealer of Maruti vehicles. The 3rd respondent suffered an accident on 09.09.2013, and seeking compensation, he filed O.P.(MV) No.1630/2015 before the Motor Accident Claims Tribunal, Ernakulam. Ext.P2 award would reveal that the Claim Petition was filed in the year 2015, and the award was passed on 14.03.2017. All the respondents in the claim petition, including the petitioner herein, remained absent, and they were set ex parte. The Tribunal held that the claimant would be entitled to realize a sum of Rs.96,750/- from the respondents.

that the petitioner came to know about the award. On receipt of the notice, the petitioner appeared and filed an application for setting aside the ex parte award. For non-appearance, the application was dismissed, and to restore the same, another application was filed. The said application was also dismissed for the failure to take steps on time. Thereafter, another application was filed to restore the earlier application. It is stated that the said application stands posted to 02.02.2022.
c) While so, notice in Form No.1 under Section 7 of the Revenue Recovery Act was served on the petitioner to recover the amounts. It is stated that pending consideration of the application for restoration if revenue recovery proceedings are brought to fruition, serious injustice would be caused.
d) The petitioner contends that subsequent inquiries conducted by the petitioner have revealed that the car was owned by some other person and not the petitioner.
