as Ext.R6(b), that the Pongenpara-Panamkunnumugal road lies on the eastern side of the property owned and possessed by the party respondents. From the counter affidavit filed by the Panchayat, it is evident that the Pongenpara-Panamkunnumugal road is included in the asset register. I find that the learned Munsiff, after considering the application for injunction filed by the contesting parties, had ordered the party respondents from interfering with the usage of the pathway by the petitioner. Though the Appellate Authority interfered with the above order and interdicted the petitioner from plying heavy vehicles, this Court has stayed the said order. This Court has interdicted the parties on either side from destroying or causing damage to the pathway. The petitioner has asserted that he shall also strictly comply with Exhibit P11 order issued by the learned Munsiff in OS No 41/2022. As rightly submitted by the learned counsel appearing for the party respondents, the civil rights are to be determined by the Civil Court. Until such an order is passed, the question is whether the petitioner can be prevented by the party respondents from using the road lying on the eastern side of their property. If interference is made, can direction be issued to the official respondents to interfere and ensure that law and order is maintained, is the next moot question?
